1. LEGAL INFORMATION AND ACCEPTANCE

These Terms and Conditions regulate the use of the service www.REGALOSJC.COM (hereinafter, the "REGALOSJC.COM") that INGENIARTE JC, S.L. (hereinafter, REGALOS JC) makes available to Internet USERS.

INGENIARTE JC, S.L. with registered office at Calle Príncipe 15-Bjo, 47005 Valladolid (Spain) and Tax ID (CIF) B10937225 is registered in the Mercantile Register of Valladolid, Volume 1620, Folio 43, 1st Registration with Sheet VA-33348.

The use of REGALOSJC.COM grants the status of USER of REGALOSJC.COM (hereinafter, the "USER") and implies the acceptance of all the rules of use contained in this Legal Notice. The provision of the REGALOSJC.COM service has a limited duration to the moment the USER is connected to it or to any of the services provided through it. It is therefore advisable for the USER to carefully read these Terms and Conditions each time they intend to use REGALOSJC.COM, as it and its terms of use may undergo modifications.

The acceptance of these Terms and Conditions implies that the USER is aware of its terms and agrees to comply with them. In no case does REGALOS JC guarantee the availability or future maintenance of the services accessible through REGALOSJC.COM. REGALOS JC may at any time decide the interruption, suspension, or definitive cancellation of this REGALOSJC.COM without any compensation for the USERS.

The information society services provided by REGALOS JC to USERS through REGALOSJC.COM (information supply, Newsletter, etc.) are free of charge with the sole exception of those resulting from electronic purchases made through REGALOSJC.COM.

All prices published on REGALOSJC.COM include applicable taxes.

Electronic purchases made by USERS through this REGALOSJC.COM are subject to the general terms of purchase (hereinafter, the "General Terms of Purchase"). These General Terms of Purchase constitute the main legal document of the sales contract and regulate the rights and duties of USERS as customers of REGALOS JC.

It is therefore advisable that before starting purchases on our REGALOSJC.COM, USERS carefully read these General Terms of Purchase. REGALOS JC may modify these General Terms of Purchase at any time. The modifications made will not, in any case, affect purchases that USERS have made prior to the approval of such modifications, which will in all cases be governed by the General Terms in force at the time of making those other purchases. It is the USER's responsibility to know the General Terms of Purchase in force at the time the Purchase Process begins.

The General Terms of Purchase as well as the other documents of the sales contract are available in Spanish.

2. USER REGISTRATION

To facilitate electronic purchasing and avoid having to ask customers for the same data every time they make a new purchase, it is necessary to register as a USER of REGALOSJC.COM. This USER registration can be done at any time through the “Log in” section or during the purchase process itself. At the end of the registration process, the USER will receive an email confirming that the process has finished correctly.

You can access the registered USERS section with your USER name and password or the means that, in each case, REGALOSJC.COM enables to authenticate USERS. Associated with your USER registration, REGALOSJC.COM may use cookies or other similar means that allow recording your browsing preferences and identifying you when you connect from the same device.

Through the USER Registration, you can access your purchase history, consult and edit your registration data, or manage operations related to your purchases.

Registration as a USER of REGALOSJC.COM is free of charge and is not subject to any condition or consideration. You can unsubscribe as a USER at any time by contacting Customer Service. Unsubscribing as a USER will entail the cancellation of your personal USER data as well as the impossibility of making online purchases in the future until you re-register as a USER.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY

All the contents of REGALOSJC.COM, including, but not limited to, texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the "Contents"), are the intellectual property of the collaborating brands or those distributed by REGALOSJC.COM and subsequently ceded to REGALOSJC.COM, without any of the exploitation rights recognized by current intellectual property regulations being understood as assigned to the USERS.

Notwithstanding the foregoing, during the time USERS remain connected to REGALOSJC.COM, they may use said Contents to the extent necessary for browsing and only insofar as said Contents are accessible in accordance with the rules provided in this Legal Notice. Once the USER disconnects from our REGALOSJC.COM, they will not retain any right of use over the previous Contents.

The trademarks, trade names, or distinctive signs are the property of REGALOS JC or third-party companies that have consented and assigned the rights of use thereof to REGALOS JC and REGALOSJC.COM, without the access to REGALOSJC.COM being understood to attribute to the USERS any right over the aforementioned trademarks, trade names and/or distinctive signs.

4. TERMS OF USE OF REGALOSJC.COM

4.1. GENERAL TERMS OF SALE

USERS of REGALOSJC.COM are obliged to make correct use of REGALOSJC.COM in accordance with the Law and this Legal Notice. The USER who breaches the Law or these Terms and Conditions will be liable to REGALOS JC or to third parties or Companies that have commercial relations with REGALOS JC for the use of REGALOSJC.COM, for any damages that may be caused as a result of the breach of said obligation.

The use of REGALOSJC.COM for purposes harmful to the assets or interests of REGALOS JC or Companies that have commercial relations with REGALOS JC for the use of REGALOSJC.COM is expressly prohibited; or that in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or computer products and applications (software) of REGALOS JC or third parties.

The purchase and use of our products and services, offered on REGALOSJC.COM, implies the acceptance of the following general terms of sale and is subject to current legislation.

The buyer's obligation is to read and accept before making the purchase.

PRICES

The prices of REGALOSJC.COM include the corresponding Value Added Tax (VAT), except in the section dedicated to material and exclusively intended for professionals.

Offers for discounts, promotions, quantity, etc., are not cumulative with each other. The most favorable one will be applied to the customer, at the discretion of REGALOSJC.COM.

REGALOSJC.COM reserves the right to modify the general terms without prior notice, and these will be accessible on the website for consultation.

Once the order is placed, the general terms are those in force at the time of purchase.

4.1.1. SHIPPING

• If the company is located in a European or non-EU country, send us your details and VAT number and we will issue you an invoice exempt from this tax.
• Shipping costs are paid only in Spain and for purchases over 60.50 Euros net.
• In the event that the customer has to pay shipping and packaging costs, they depend on the destination location, weight, and volume of the merchandise, and will appear together with the purchase price made and before payment thereof.
• The purchase will be considered completed when REGALOSJC.COM has received the payment in account (with credit or debit cards it is instantaneous) by transfer it usually takes a maximum of 2 days.
• Orders will always be placed as soon as possible to comply with delivery times.
• Delivery times may vary from approximately 2 to 5 business days. This will depend on whether the product is personalized and the destination location. If they are new products to be manufactured or large quantities, approximately 10 to 20 business days (consult).

Home deliveries.

• If the transport company does not find anyone at the indicated address, they will leave a notice or notification.
• We are not responsible for the poor practices of third parties: transport, delivery personnel, etc., nor responsible for errors made by the buyer: incomplete or erroneous telephone numbers and addresses, absences during package collection, at the destination location, absence after several delivery attempts, not contacting the agency later, etc.
• After several delivery attempts of the merchandise, the transport will return the package to our facilities. We will contact the customer again to proceed with a new shipment, for which they will have to cover the incurred costs (collection and shipping). If the customer does not respond to our notices, we will keep the package for 6 months, after which the merchandise will be destroyed.

4.1.2. RETURNS AND CANCELLATIONS

Product Returns.

• The buyer has a period of 14 calendar days to return the product.
• You must communicate your withdrawal using a form requested previously from RegalosJC.
• Most products purchased from RegalosJC can be returned, provided they are unused, in perfect condition, and unassembled. Including accessories, documentation, and packaging, otherwise, the item will suffer depreciation. We remind our customers that it is advisable that the packaging is in perfect condition.
• In accordance with the exceptions to the Right of Withdrawal regulated in RDL 1/2007, the return of custom-configured (personalized) products will not be accepted.

Return costs

• RegalosJC will proceed with the refund within 14 days from the date the customer communicates their decision to withdraw by sending the corresponding completed and signed form via email.
• The amount you paid corresponding to the return of the products you purchased will be refunded, including, if there were any and you paid for them, the shipping costs of the order to your home. However, when you opt for a special type of delivery, for example, urgent in 24 hours, having options for cheaper delivery methods, only the price corresponding to the cheapest delivery method must be refunded. The refund will be made once the product(s) to be returned have been received and it has been verified that they are in perfect condition.
• In case of returning items whose collection is made at the home address, the direct cost of returning the goods or service will be assumed by the customer as stated in the LGCU (Spanish General Law for the Defense of Consumers and Users).

Partial/Total Return Costs (Origin: Peninsular Spain, Balearic Islands)

• If the product weighs less than 3 kilos: €7.90
• From 3 kilos, each additional kilo: €0.65/kg.

Personalized products do not admit returns in compliance with article 45 of Law 7/1996 of January 15 on Retail Trade, there will be no right of return in the case of merchandise manufactured/personalized according to customer specifications or that have been clearly custom-made for the customer. Nor will there be a right of return in case the damage is due to misuse.

Returns arising from an error for which REGALOSJC.COM is responsible or a product defect are excluded from this jurisdiction. In such a case, our company undertakes to exchange the defective product for an equal one as soon as possible. We will also cover the return and shipping costs. In the event that the exchange cannot be made, the amount will be refunded.

If the product is defective due to poor management by REGALOSJC.COM, we will proceed, as appropriate, to repair, replacement, price reduction, or termination of the contract, at no cost to the user.

The user must never accept packages that are clearly damaged.

If it is an exchange due to an error in the choice of size or color or any of the product options, an error for which the buyer is responsible, the buyer will cover the return costs.

The purchased product may be sent inside a case, box, or wrapper adapted to said product. This case or wrapper is an element provided for better protection and presentation of the product, but outside the price of the product, so in the case of arriving broken or with any defect, it is not replaced, restocked, or paid for. Only the personalized product itself is covered for repeat orders or refunds if it meets the necessary conditions (printing failure, manufacturing, etc.)

Personalized products are manufactured with the image and/or text sent by the user, in the same position, quality, resolution, and measurements. The user is responsible for ensuring that the image or text they send when placing the order has adequate requirements for correct manufacturing.

REGALOSJC.COM assumes no responsibility for the difference in color or resolution between the original image and that of the supplied product, caused by defective quality of the original image file. To resolve doubts about minimum requirements, please contact us. Claims based on aesthetic taste will not be a justified reason for any return.

Money is not refunded for urgent shipments.

4.1.3. CANCELLATIONS

• The customer may request the cancellation of an order if it has not been shipped. If it has already left our facilities, the cancellation request will be considered a withdrawal.
• The buyer will have a period of 7 calendar days to withdraw from the purchased product (personalized products are not included), although the buyer must cover the costs derived from transport and, if applicable, return costs.
• The merchandise will be verified upon receipt and if its condition is as it was when it left the factory, a refund will be processed.
• In the case of products manufactured according to consumer specifications or clearly personalized, cancellation will not be accepted if production has already started (this usually starts about 24 hours after the purchase is made).

4.1.4. ORDER ADMISSION RIGHT POLICY

REGALOSJC.COM reserves the right to reject or cancel orders that do not comply with our rules.

Texts or images that contain insulting, discriminatory content, that incite violence, that may hurt sensibilities, that prejudice the rights of women or children, that are sexual or explicit in nature, or that may damage their own image or the image of REGALOSJC.COM. An order that meets any of these assumptions may be canceled even after the confirmation email reaches the buyer.

If this occurs, REGALOSJC.COM will notify the buyer of the order cancellation and/or provide a full refund of the amount paid.

4.1.5. REFUND

• The refund for one of the aforementioned circumstances will be made by bank transfer.
• If you paid by card, the payment will be credited to your account, by transfer, within 48 to 72 business hours once the good condition of the returned merchandise has been verified. It may take 10 business days for it to be credited to your account, depending on the payment gateway you used.
• If you paid by transfer, you will have to send us your account number. From this moment, the payment will be made within 48 to 72 business hours once the good condition of the returned merchandise has been verified.
• In any case, the user or buyer will have to request the return and refund through a form requested previously from RegalosJC.

4.2. CONTENTS

USERS of REGALOSJC.COM undertake to use the Contents in accordance with the Law and this Legal Notice, as well as with the other conditions, regulations, and instructions that may be applicable to certain services in accordance with the provisions of clause 1.

Merely for illustrative purposes, USERS must refrain from:

• Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents except in cases authorized by law or expressly consented to by REGALOS JC or by whoever holds the ownership of the exploitation rights, as the case may be.
• Reproducing or copying for private use the Contents that may be considered as Software or Database in accordance with current intellectual property legislation, as well as their public communication or making available to third parties when these acts necessarily imply reproduction by the USER or a third party.
• Extracting and/or reusing all or a substantial part of the Contents of REGALOSJC.COM as well as the databases that REGALOS JC makes available to USERS.

4.3. DATA COLLECTION FORMS

Without prejudice to the provisions of clause 6 of this Legal Notice, the use of certain services or requests is conditioned on the prior completion of the corresponding USER registration.

All the information provided by the USER through the REGALOSJC.COM forms for the aforementioned purposes or any other must be truthful. For these purposes, the USER guarantees the authenticity of all the data communicated and will keep the information provided perfectly updated so that it responds, at all times, to the USER's real situation. In any case, the USER will be solely responsible for any false or inaccurate statements made and for the damages caused to REGALOS JC or third parties by the information provided.

Additionally, by completing the forms, USERS declare to be over 18 years of age.

4.4. INTRODUCTION OF LINKS TO REGALOSJC.COM

Internet USERS or Information Society Service providers who wish to introduce links from their own web pages to REGALOSJC.COM must comply with the conditions detailed below:

• The link will only link to the home page or main page of REGALOSJC.COM but may not reproduce it in any way (inline links, copying of texts, graphics, etc.). Interaction systems such as Web 2.0 offered from REGALOSJC.COM to link to it are excluded from the foregoing.
• It will be prohibited in all cases, in accordance with the applicable and current legislation at all times, to establish frames or frameworks of any type that enclose REGALOSJC.COM or allow the visualization of the Contents through Internet addresses other than those of REGALOSJC.COM and, in any case, when they are viewed jointly with external content to REGALOSJC.COM in a way that: (i) causes, or may cause, error, confusion, or deception in USERS about the true origin of the service or Contents; (ii) constitutes an act of unfair comparison or imitation; (iii) serves to take advantage of the reputation of the brand and prestige of REGALOS JC, its collaborating and/or distributed brands; or (iv) in any other way is prohibited by current legislation.
• No false, inaccurate, or incorrect statements will be made from the page that introduces the link about REGALOS JC, its partners, employees, members, or about the quality of the services it offers to USERS.
• In no case will it be expressed on the page where the link is located that REGALOS JC has given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies, or supervises the services of the sender.
• The use of any denominative, graphic, or mixed trademark or any other distinctive sign of REGALOSJC.COM or REGALOS JC or Companies that have commercial relations with REGALOS JC for the use of REGALOSJC.COM within the sender's page is prohibited except in cases permitted by law or expressly authorized by REGALOS JC and provided that a direct link to REGALOSJC.COM is permitted in these cases, in the manner established in this clause.
• The page that establishes the link must faithfully comply with the law and may not in any case dispose of or link to its own or third-party content that: (i) is illegal, harmful, or contrary to morality and good customs (pornographic, violent, racist, etc.); (ii) induces or may induce in the USER the false conception that REGALOS JC or Companies that have commercial relations with REGALOS JC for the use of REGALOSJC.COM subscribes to, supports, adheres to, or in any way supports, the ideas, manifestations, or expressions, lawful or unlawful, of the sender; (iii) are inappropriate or irrelevant to the activity of REGALOS JC considering the location, content, and theme of the sender's website.

5. EXCLUSION OF LIABILITY

5.1. QUALITY OF SERVICE

Access to REGALOSJC.COM does not imply any obligation on the part of REGALOS JC to guarantee the total absence of viruses, worms, or any other harmful third-party computer element ("Malicious Software" or "malware") during browsing. It is the USER's responsibility, in any case, to have adequate tools for the detection and disinfection of harmful computer programs.

REGALOS JC is not responsible for damages caused to the computer equipment of USERS or third parties by acts of third parties during the provision of the REGALOSJC.COM service.

5.2. SERVICE AVAILABILITY

Access to REGALOSJC.COM requires third-party services and supplies, including transport through telecommunications networks whose reliability, quality, security, continuity, and operation are not the responsibility of REGALOS JC. Consequently, the services provided through REGALOSJC.COM may be suspended, canceled, or become inaccessible, prior or simultaneous to the provision of the REGALOSJC.COM service without the need for prior notification by REGALOS JC. Notwithstanding the foregoing, in the event that, for any reason, REGALOS JC definitively ceases to provide the REGALOSJC.COM services, REGALOS JC will make its best efforts to communicate said incident to Registered USERS.

REGALOS JC or the Companies that have commercial relations with REGALOS JC for the use of REGALOSJC.COM, will not be responsible for damages or losses of any kind caused to the USER arising from failures or disconnections in the telecommunications networks that cause the suspension, cancellation, or interruption of the REGALOSJC.COM service during the provision thereof or beforehand.

5.3. REGARDING CONTENT AND SERVICES LINKED THROUGH REGALOSJC.COM

REGALOSJC.COM may include links that allow the **USER** to access other pages and Internet sites (hereinafter, "Linked Sites"). In these cases, **REGALOS JC** acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce ("LSSI") and will only be responsible for the content and services provided on the Linked Sites to the extent that it has **effective knowledge of the illegality** and has not deactivated the link with due diligence. Should the **USER** consider that there is a Linked Site with illegal or inappropriate content, they may notify **REGALOS JC** in accordance with the procedure and effects established in clause 6 of this Legal Notice, without this communication implying an obligation to remove the corresponding link under any circumstances.

In no case should the existence of Linked Sites presuppose the existence of agreements with the persons responsible or owners of the same, nor the recommendation, promotion, or identification of **REGALOS JC** with the statements, content, or services provided.

**REGALOS JC** is not aware of the contents and services of the **Linked Sites** and, therefore, is not responsible for the damages caused by the illegality, quality, outdatedness, unavailability, error, and uselessness of the content and/or services of the Linked Sites, nor for any other damage that is not directly attributable to **REGALOS JC** for its own services.

**REGALOS JC** reserves the right to make the modifications it deems appropriate to its website without prior notice. **REGALOS JC** reserves the right to deny or withdraw the possibility of access to its website to any user who fails to comply with its terms of use, as indicated in this Legal Notice, exercising, where appropriate, the corresponding civil and criminal actions.

**REGALOS JC** is not responsible, under any circumstances, for damages of any kind that may be caused by errors and/or omissions in the content, availability, virus transmissions, malicious programs, etc., that may occur, despite having adopted all kinds of measures that we have considered necessary and appropriate to avoid this type of circumstance.

The products that appear in our catalog may undergo some slight modification with respect to the graphic reproduction. We recommend requesting samples in case of doubt. **REGALOS JC** reserves the right to modify prices without prior notice, depending on currency fluctuation. The prices reflected by **REGALOS JC** include VAT and are the current prices unless there is a **typographical error**.

5.4. REGARDING THIRD-PARTY CONTENT HOSTED BY REGALOS JC

**REGALOSJC.COM** includes or may include the possibility for **USERS**, registered or not, to include comments about the products or, in any other way, participate by issuing personal opinions or certain information. In these cases, **REGALOS JC** acts as an intermediary hosting service provider in accordance with article 16 of Law 34/2002, of July 12, on Services of the Information Society and Electronic Commerce ("LSSI") and will only be responsible for the content uploaded by other **USERS** to the extent that it has **effective knowledge of the illegality** and has not removed the illegal content with due diligence. Should the **USER** consider that there are comments or content uploaded by other **USERS** that are illegal or inappropriate, they may notify **REGALOS JC** in accordance with the procedure and effects established in clause 6 of this Legal Notice, without this communication implying an obligation to remove the corresponding comment or content under any circumstances.

In no case should the existence of third-party comments or content presuppose the existence of agreements with the authors of the same, nor the recommendation, promotion, or identification of **REGALOS JC** with the statements or information provided.

5.5. REGARDING THE CONFIDENTIALITY OF INFORMATION TRANSMITTED THROUGH REGALOSJC.COM

**REGALOS JC** has adopted the legally required security measures to guarantee the confidentiality and secrecy of the personal data that **USERS** provide on our **REGALOSJC.COM**. Notwithstanding the foregoing, the transmission of said data to **REGALOS JC** circulates through third-party telecommunications networks not controlled by **REGALOS JC**. Additionally, the existence of **malicious software** on your equipment may mean that said information may be forwarded or retrieved without your knowledge.

**REGALOS JC** is not responsible for the lack of confidentiality of the information transmitted by third-party equipment and telecommunications networks or for the software or hardware vulnerabilities of the **USERS'** own equipment.

6. PURCHASE PROCESS

Throughout the entire purchase process, you can consult these **General Terms and Conditions of Purchase**, as well as ascertain the final price of the selected products.

Once the purchase is confirmed, the customer may not modify or cancel the order outside the cases provided for by law or in these **General Terms and Conditions**.

By making a purchase, customers declare acceptance of all of these general terms and conditions of purchase.

Purchases are made directly on the **REGALOSJC.COM** website. **REGALOS JC** archives the data from its website, which constitutes proof of all transactions carried out between **REGALOSJC.COM** and its customers.

**REGALOSJC.COM** will confirm to the customer by email that their order has been registered, and will also inform them of the shipment of the requested product. For any use of the customer's email address for sending subsequent commercial communications, **REGALOSJC.COM** must expressly notify the customer and request their consent. Said consent may be revoked by the customer at any time they deem appropriate, by simply sending an email to regalosjc@REGALOSJC.COM

When purchasing from **REGALOS JC**, shipping costs will be added if your purchase is less than **400 euros**. Above this amount, all shipments are **free**.

Payment Methods

We offer you three payment methods so you can choose the one that suits you best:

Debit/Credit Card:

In compliance with EMVCo, MasterCard, VISA regulations and the European PSDII Directive, during the electronic payment operation, information related to the connection used in the session will be communicated to the card's issuing bank to proceed with the validation of the payment operation made by the user. When making your purchases with a credit or debit card, you are not redirected to another site since the website is integrated into a **100% secure payment platform**. The payment platform we work with has been developed by **PAYCOMET, a Banco Sabadell Group company** expert in digital payments. It is one of the most advanced solutions for fraud control. The user will consent to future payments being initiated by the merchant (MIT Operations) and allow the deletion of their data to comply with **GDPR**.

Paypal:

We **do not** have this option enabled, so you cannot make your payment with a Paypal account. There is **no additional cost** for this option.

Bank Transfer:

We will provide you with a bank account number to make the payment for your orders. Once the transfer has been made and we have received it, your order will be sent to you.
